Terms of service

These terms govern your access to and use of TocsinWire (the "Service"). By using the Service you agree to them. If you are using TocsinWire under a separate trial agreement or order form, that agreement prevails where it conflicts with this page.

1. The Service

TocsinWire monitors official public sources, detects changes, and generates evidence-bound draft text for editorial review. TocsinWire is a tool for journalists and editors; it does not auto-publish, and the customer's human editors are solely responsible for what they choose to publish.

2. Accounts & access

You are responsible for maintaining the security of your accounts and for activity under them. Access is licensed to your organisation for the source packs and tier you subscribe to.

3. Acceptable use

You agree not to misuse the Service, including attempting to access another tenant's data, interfering with monitoring, or using the Service to breach the terms or access controls of any third-party source.

4. Accuracy, completeness & automated outputs

The Service monitors third-party sources and produces automated outputs. Every signal, headline, summary, score, classification and location is a machine-generated best estimate, not a verified statement of fact. TocsinWire supports professional editorial judgement; it does not replace it.

Automated outputs may be wrong. This includes draft text and summaries; the priority or severity score; the assigned location, region or municipality; categories, entities and other extracted attributes; and the grouping of related updates into a single signal. Scores and rankings are heuristic aids for ordering attention — they are not assessments of importance, severity or truth. Signals may be surfaced before the underlying event is confirmed, and are labelled accordingly.

We do not warrant that the Service is complete. We may fail to detect, or fail to deliver, material that a source publishes — because a source becomes unavailable, changes format or restricts automated access, or because our extraction, classification or delivery does not work as intended. The absence of a signal is not evidence that nothing happened, and must not be relied on as such.

Detection is periodic rather than continuous, and latency varies by source. Alerts and notifications may be delayed, duplicated, or fail to arrive. We do not commit to any detection or delivery time unless a separate service-level agreement states otherwise in writing.

Source coverage changes over time. Sources may be added, paused, changed or removed, and the inclusion of a source is not a commitment to monitor it indefinitely. Where source material is translated or summarised into another language, the original source material prevails.

You are responsible for verifying against the linked source evidence before you publish, broadcast, or otherwise act on anything in the Service. Your editors decide what is published and remain solely responsible for it.

5. Not an emergency or safety-critical service

The Service is not an emergency notification, public-warning or life-safety system, and must not be used as one. Some sources we monitor are operated by emergency services, civil-protection agencies and weather authorities; our reproduction of that material is not authoritative and may be incomplete, delayed or wrong. Do not rely on the Service for any decision affecting personal safety, evacuation, medical care or the protection of property. Always follow the instructions issued directly by the responsible authority.

6. Fees

Paid subscriptions are billed per source pack at the tier and currency stated in your order. Fees are non-refundable except as required by law or expressly agreed.

7. Intellectual property

TocsinWire and its software remain our property. Your editorial content, house style and feedback remain yours.

8. Warranties & liability

The Service is provided "as is" and "as available" to the extent permitted by law, without warranty of accuracy, completeness, availability or fitness for a particular purpose. To the extent permitted by law we are not liable for editorial decisions you make, for material we did not detect or deliver, or for indirect or consequential loss. Our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. Nothing limits liability that cannot be limited by law.

9. Termination

Either party may terminate per the order term. We may suspend access for material breach.

10. Governing law

These terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction.
